INTRODUCTION – The commercial relations between Delta OHM S.r.l. and its customers are regulated exclusively by the following terms of Sales & Service which replace and supersede any other previous agreement.
LIABILITY – Delta OHM S.r.l. shall not be liable for any direct or indirect damages resulting from late or non-delivery of the product, for any non-correspondence of the goods to the specifications published in the catalogues or any other event.
TECHNICAL INFORMATION – We reserve the right to change without notice the technical specifications and dimensions to fit the product’s requirement.
MINIMUM AMOUNT – The minimum amount per invoice, net of the discount, is EUR 260. For orders of lower amounts, EUR 40 NET will be charged.
ORDERING – All orders are subjected to acceptance by DeltaOHM. Please, email your orders to firstname.lastname@example.org or fax them to +39049635596. The email email@example.com is for incoming orders only. You will be receiving an Order Confirmation, with shipping date and terms of purchase. Please check all Orders Confirmations for accuracy and advise Delta OHM of any discrepancies with a purchase order.
PRICES – The prices indicated are NET, Incoterms® 2020 FCA DeltaOHM Padua (Free Carrier). Delta OHM reserves the right to modify the prices without notice. Certificates of Origin and Consular VISA are not included and will be charged at cost.
SHIPPING AND DELIVERY – Prices do not include shipping costs, which are to be borne by the customer. Upon specific request, the cost of transport can be quoted and Invoiced, once agreed and accepted in writing. The delay in delivery of the order/product does not generate any right or compensation from the buyer/customer. No deliveries are made to end users, unless previously agreed with Delta OHM.
ACCREDIA IEC 17025 CERTIFICATES/ISO 9001 REPORTS – ACCREDIA IEC 17025 Calibration Certificates and ISO 9001 Calibration Reports are subject to a fee and issued only upon specific customer’s request. In case of purchase orders of new Delta OHM instruments, ISO 9001 Calibration Reports and ACCEDIA IEC 17025 Calibration Certificates should be requested at the time of ordering, otherwise it will be necessary to return the items to be calibrated to our LAT124 Calibration Centre. Once the Certificates/Reports are issued, it will not be possible to change the name of the end user except with a new calibration, for fee. If not expressly requested, the calibration points will be chosen at the discretion of our laboratory operator, within the specifications of the instrument. The hard copy of the Certificate/Report is the only one released and delivered together with the instruments. In no cases our LAT124 Calibration Center issues ACCREDIA Certificates in digital format or send them via fax or e-mail.
PAYMENTS – In case of late payment, we reserve the right to charge interest for late payment of 5% higher than the “Prime Rate”, in force at the date of Invoice.
CHANGES AND CANCELLATIONS – Modifications or cancellations of orders in progress will be accepted after a written request by the customer and written confirmation by Delta OHM, which reserves the right to charge the customer the costs incurred for management, normally equal to 20% of the value indicated in the order.
CLAIMS – Any claims must be promptly communicated to firstname.lastname@example.org by quoting our Order Confirmation and/or Invoice number, not later than 7 days from the date of receipt of the material.
RISK AND PROPERTY – For the goods shipped, the risk passes to the customer from the time of delivery to the courier or other carrier. The customer assumes the responsibility to insure the goods. It is recommended to verify the integrity of the goods upon receipt of packaging.
RIGHT OF WITHDRAWAL – As required by the Legislative Decree 15 January 1992, n.50, the customer has the right to terminate the contract. The Customer wishing to exercise the “right of withdrawal” must send a written notice within 7 days from receipt of the goods by registered mail with return receipt to: Delta OHM Srl, Via Marconi No. 5, 35030 Caselle di Selvazzano (PD), Italy. For the application of the right to withdraw, the integrity of products and packaging is essential. The cost of return shipment shall be borne by the customer. Delta OHM returns the sum, except for any costs which are charged to the customer. Goods returned without any of the above requirements will be rejected.
REQUEST TO RETURN OF GOODS – The request for return of goods must be sent to email@example.com within 7 days from receipt of the goods by specifying the reason and by quoting our Order Confirmation and/or Invoice. Delta OHM reserves the right to charge an amount for inspection and re-packaging. In any case, it is necessary to wait for the Return Merchandise Authorization (RMA) number from Delta OHM, which must also appear on the shipping documents. The goods must be shipped prepaid within one week of notification of the RMA number and must be intact, in its original packaging and complete with accessories. Goods without any of the above requirements will be rejected.
WARRANTY – Delta OHM is required to respond to the “factory warranty” only in cases provided by Presidential Decree May 24, 1988 224. Each instrument is sold after rigorous inspections, if any manufacturing defect is found, it is necessary to contact the distributor where the instrument was purchased. During the warranty period (24 months from date of invoice), all manufacturing defects found will be repaired free of charge. Misuse, wear, neglect, theft and damage during transport are excluded. Solutions, probes, electrodes and microphones are not guaranteed as the improper use, even for a few minutes, may cause irreparable damages. Delta OHM will repair those products that show technical defects of construction according to the terms and conditions of the warranty card included in the manual of the product. Warranty is not applied if changes, tampering or unauthorized repairs are found on the product, or for a use different from the one described in the technical documentation, or for lack or inefficient maintenance.
OUT OF WARRANTY REPAIRS – EUR 40.00 (EUR 60.00 for sound level meters, vibration meters, instruments for environmental analysis) will be charged for technical inspection of instruments sent for repair not covered by warranty and for request for quote or repair of instruments that do not show any anomaly.
COMPETENCE – For any dispute, refer to Padua jurisdiction. The Italian law is applied, according to the Vienna Convention (1980).
DATA TREATMENT INFORMATION – The processing of data concerning you is carried out within the database of our company and in compliance with the provisions of GDPR 2016/679 Articles. 13 and 14 on the protection of personal data. The processing of data, of which we guarantee the utmost confidentiality, is carried out exclusively for the purpose of implementing the rules of the commercial contract (orders, documents of transport, invoices, processing data on behalf of third parties), for which no expression of consent is required. Your data may only be disclosed to third parties for mandatory legislative purposes to public and private bodies and consultants outside our company. They will not be disclosed to third parties and for them you can request, at any time, the modification or cancellation, exercising the right. 15, 16, 17, 18, 19, 20, 21, 22 – Rights of the interested party. You can do so by sending an email to the Owner and / or the Security Officer of the data processing at firstname.lastname@example.org.
The Centre LAT124 undertakes to maintain the utmost confidentiality on all the Customer’s data and information and not to disclose any information of which it will become aware in the course of providing the service, unless:
- The information is not in the public domain;
- The laboratory is not required by contractual agreements to provide information to the accreditation body (reports to ACCREDIA showing the numbers of the calibration certificates issued by the laboratory, the relative data of the calibrated instrument and the identification of the recipient of the Certificate).
- The laboratory is not required by law to communicate this information.
Employees, managers, directors, collaborators and consultants, whether permanent and/or occasional, of the laboratory and any external suppliers in relation to the service rendered to you are subject to this obligation of confidentiality.
